Affiliate Terms & Conditions

1) Introduction
These Affiliate Terms & Conditions (“Terms”) govern participation in the ClickOptions Affiliate Program (“Program”). By joining, you agree to these Terms as well as the Terms of Service, KYC/AML Policy, Restricted Jurisdictions Policy, Risk Disclosure, and Privacy Policy of Gamma Desk S.A., registration number 155773887, incorporated in Panama (the “Company”).
Purpose. Reward affiliates for introducing legitimate clients. Abuse (wash trading, false promises, restricted-jurisdiction solicitation, spam) leads to suspension, clawbacks, or termination.
2) Eligibility & Verification
- Affiliates must complete Standard KYC (ID + selfie + proof of address) before earning/payouts.
- You must be 18+ and not in a prohibited jurisdiction.
- Participation is at ClickOptions' sole discretion.
3) Compensation: Fees, Bonuses & Special Terms
- Revenue Share. By default, you earn a percentage of trading fees paid by referred clients. Rates and payout cadence are shown on the Platform and/or the Website and may change.
- Other Incentives. You may receive one-time bonuses, milestone rewards, flat CPAs, hybrid structures, marketing support, or other incentives.
- Special Conditions. Any non-standard arrangement (rates, bonus triggers, bespoke caps, geo constraints) must be agreed in writing (email or signed addendum) and will override the default structure for the stated term.
- Caps, Holds, and Adjustments. We may apply payout caps, rolling holds, or adjustments for risk control, fraud checks, or abnormal activity.
- Taxes. You're responsible for your own tax filings and documentation.
4) Independent Contractor Status (No Employment)
- Your participation does not create an employment, partnership, franchise, joint venture, agency, or fiduciary relationship with ClickOptions.
- You act as an independent contractor and have no authority to bind the Company.
5) Prohibited Conduct (Marketing & Ethics)
You must not:
- Promise profits, “guaranteed returns,” or imply risk-free trading.
- Provide investment advice or hold yourself out as regulated when you are not.
- Solicit in or target users in prohibited jurisdictions (see Restricted Jurisdictions Policy).
- Solicit in “restricted-marketing” regions (e.g., EU/UK/UAE/Singapore) where ClickOptions does not actively market, unless expressly approved in writing and strictly under our reverse-solicitation guidance (which we may operate only via website pop-up acknowledgment).
- Use spam, bots, purchased databases, forced clicks, ad cloaking, brand bidding on restricted terms, or misleading funnels.
- Misuse trademarks, create fake support pages/profiles, or mimic the ClickOptions UI.
- Create, refer, or control self-referrals or networks used for wash/circular trading or commission farming.
- Run paid ads that omit risk warnings or misrepresent fees, spreads, or product availability.
6) Mandatory Marketing Standards
- Truthful & Balanced. All claims must be accurate, non-misleading, and balanced with clear risk warnings (e.g., “Trading digital asset options involves high risk, including possible loss of all invested capital.”).
- Territorial Controls. You must use geo-targeting to exclude prohibited jurisdictions and respect restricted-marketing guidance we provide.
- Brand Use. Use only approved logos and creatives or obtain written approval before launching custom materials.
- Disclosures. Clearly disclose “Affiliate/paid partnership” where required by law or platform policy (FTC, ASA, etc.).
- Records. Keep copies of campaigns and audience targeting for 12 months and provide them on request.
7) Commission Integrity Controls
- Monitoring. We monitor referred accounts, trading patterns, IP/device overlaps, funding sources, and affiliate ratios.
- Unverified Flow Ratio. We may limit or withhold payouts if an excessive share of your volume comes from unverified users.
- Wash/Circular Trading. Identical, opposite-side trades (same strike/expiry/size) within short windows or loops of related accounts are red flags.
- Temporary Holds. We may hold commissions while investigating anomalies; abusive payouts are clawed back.
8) Clawbacks & Withholding
We may withhold or claw back commissions for:
- Prohibited marketing or jurisdictional breaches,
- Wash/circular trading, self-referrals, or sham activity,
- Fraud, identity misrepresentation, or sanctions/AML issues,
- Accounting error or violation of these Terms.
9) Payments
- Payouts are made in digital assets to your verified wallet, subject to minimum thresholds, KYC, and compliance checks.
- We may change payout schedules, currencies, or thresholds with notice on the Platform and/or the Website.
10) Data, Privacy & Compliance
- You must comply with applicable data/privacy laws (e.g., GDPR to the maximum extent applicable).
- Do not share, sell, or misuse user data.
- All user onboarding remains subject to ClickOptions KYC/AML requirements.
11) Term, Suspension & Termination
- We may suspend or terminate your affiliate account at any time (e.g., legal risk, compliance concern, brand misuse, inactivity).
- On termination, unpaid amounts tied to violations may be forfeited.
- You may terminate participation by written notice.
12) Limitation of Liability
- We do not guarantee earnings or uninterrupted program availability.
- To the maximum extent permitted by law, we are not liable for indirect or consequential losses related to the Program.
13) Changes
We may modify the Program, these Terms, or compensation rules. Material changes will be posted on the Platform and/or the Website; continuing participation means acceptance.
